Data privacy 

BE-terna places great emphasis on the security of user data and on compliance with legal data protection regulations. The collection, processing and use of personal data are subject to the provisions of currently applicable laws and the EU General Data Protection Regulation (DSGVO). According to Article 4 (1) of the DSGVO, personal data means any information relating to an identified or identifiable natural person. 

 

Privacy policy 

BE-terna warrants that it shall only collect, process and store user data that is generated in the context of processing user requests and for internal purposes. 

No data shall be transferred to third parties without the consent of the data subject or without the legal basis to do so. 

 

Data transmission – SSL encryption 

This website uses 256-bit SSL (AES 256) encryption technology. All user data is encrypted for transmission. This includes the user’s IP address. 

 

Cookies 

This website uses browser cookies. Cookies are small text files stored locally in the cache of the user’s browser. These cookies make it possible to recognise the browser. The files are used to help the browser navigate the website, and so that all functions can be used to their full extent. 

 

User control of cookies 

Browser cookies: The user can configure all browsers so that cookies are only accepted subject to confirmation. It is also possible to configure the settings so that only cookies for pages currently being visited are accepted. All browsers have functions that make the selective deletion of cookies possible. The acceptance of cookies can also be switched off in general. However, this may mean restrictions to the ease of use of this website. 

 

Use of first-party cookies (Google Analytics cookies) 

Recording Google Analytics cookies:

  • Unique users: Google Analytics cookies record and group user data. All activities during a visit are aggregated. Google Analytics cookies are set to differentiate between users and unique users.
  • User activities – Google Analytics cookies also store data about the start and end time of a visit to the website, and how many pages the user viewed. When the browser is closed or after the user has been inactive for an extended period of time (default: 30 minutes), the user session is ended and the cookie records the visit as terminated. The date and time of the first visit are recorded as well, along with the total number of visits per unique user.

Use of Google Analytics 

BE-terna uses Google Analytics, a Web analysis service of Google Inc. (‘Google’). Google Analytics uses cookies, which are text files stored on the user’s computer for the purpose of analysing the use of the website. The information generated by the cookie about the use of this website is generally transmitted to and stored by Google on servers in the USA. Google will use this information on behalf of the operator of this website for the purpose of evaluating the use of this website, compiling reports on website activities and providing other services relating to website activity and Internet usage to the website operator. 

The IP address transmitted by the user’s browser within the framework of Google Analytics is not combined with other data by Google. The user can prevent the storage of cookies through a corresponding setting in the browser software. 

The user can also prevent the transmission of data (including the IP address) recorded by the cookie and related to the use of the website to Google and the processing of this data by Google by downloading and installing the browser plugin under the following link:

Use of Google Tag Manager 

This website uses Google Tag Manager. Google Tag Manager only implements tags. No cookies are set and no personal data is recorded. Google Tool Manager triggers other tags that may record data. Google Tag Manager does not access this data. In case of deactivation at the domain or cookie level, all tracking tags remain active if they are implemented with Google Tag Manager. The user can prevent the transfer of all Google Tag Manager tags. To do so, the user has to click the following opt-out link in order to store the Google Tag Manager deactivation cookie in the user’s browser.

Use of Google Maps 

BE-terna uses Google Maps (API) from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (‘Google’). When sub-pages in which the map from Google Maps is integrated are called up, information about the use of the BE-terna website (such as the user’s IP address) is transmitted to Google servers in the USA where it is stored. 

Google may transfer this information to third parties where required to do so by law, or where such third parties process the data on Google's behalf. Google shall not link the user’s IP address with other Google data. In spite of this, it would be technically possible for Google to utilise user data received through the use of Google Maps for the identification of users, to prepare personality profiles of users on this basis or to process and use the data for other purposes; BE-terna has no influence nor is it able to exert influence in each of the aforementioned cases.

If the user does not consent to the future transmission of their data to Google in the course of using Google Maps, it is possible to deactivate the Google Maps service entirely by deactivating JavaScript in the browser. Google Maps and therefore the display of maps on be-terna.com can then not be used. 

 

Use of Google AdWords – conversion tracking 

BE-terna uses Google AdWords and conversion tracking within the scope of Google AdWords. The cookie for conversion tracking is set when a user clicks on a Google ad. These cookies lose their validity after 30 days and are not used for personal identification. When the user visits pages on this website and the cookie has not expired yet, Google and BE-terna can detect that the user clicked the ad and was redirected to this page. Thus cookies cannot be tracked via the websites of AdWords users. 

The information collected with the help of the conversion cookie is used to prepare conversion statistics for AdWords users who have opted for conversion tracking. BE-terna obtains the total number of users who have clicked its ad and were redirected to a page with a conversion tracking tag. BE-terna does not receive any information that allows the user to be personally identified. If the user does not want to take part in tracking, they can object to this use by deactivating the Google conversion tracking cookie in the user settings of the browser. Subsequently, the user is not included in the conversion tracking statistics.

Use of YouTube 

YouTube functions for the display and playback of videos are integrated in the BE-terna website. These functions are offered by YouTube, LLC 901 Cherry Ave., San Bruno, CA 94066 USA. Further information can be found in the YouTube privacy policies. 

The enhanced privacy mode is used here, which, according to the provider, starts recording user information only upon playback of the video(s). When the playback of embedded YouTube videos is started, YouTube uses cookies to collect information about user behaviour. According to YouTube, this is used among other things to record video statistics, increase user-friendliness and prevent misuse. Independently from the playback of the embedded videos, a connection to Google’s ‘DoubleClick’ network is established each time the BE-terna website is called up, which may trigger additional data processing operations outside the influence of BE-terna.

Newsletter 

The user has the option to subscribe to the BE-terna newsletter. The user has the right and option to unsubscribe from the newsletter at any time. For this purpose, simply send a corresponding e-mail to marketing@be-terna.com. An unsubscribe link in the newsletter itself may also be used.

 

E-mail security 

The user agrees to electronic communication by making contact with BE-terna via electronic means. The user is advised that e-mails may be read without authorisation or changed in the course of transmission. BE-terna uses software to filter out unwanted e-mails (spam filter). This spam filter may reject e-mails incorrectly identified as spam due to certain characteristics.

 

Right to information 

According to Article 15 of the General Data Protection Regulation (DSGVO), the user has a right to obtain information free of charge about their stored data, and a right to the correction, blocking or deletion of that data (Article 5, Paragraph 1 d), e), Article 12 and Articles 17–19 DSGVO). Upon request BE-terna shall inform the user in writing regarding what personal data of the user has been stored in accordance with the applicable laws. This information is provided free of charge. 

 

Right of the user to object 

If the user does not wish for data to be actively used for internal purposes by BE-terna, the user has the right to object to this use and processing at any time pursuant to Article 21, Paragraph 2–4 DSGVO. For this purpose, simply send a corresponding e-mail to dsgvo@be-terna.com. The special case of a statutory blocking of data instead of a data erasure mandated under Articles 17–19 DSGVO hereby remains unaffected. 

 

Data transmission and recording for internal system and statistical purposes 

When accessing this website, the user’s Internet browser automatically transmits data to the Web server for technical reasons. Each dataset consists of the date and time of access, the URL of the referring website, the accessed file, the amount of data transmitted, the browser type and version, the operating system and the IP address of the user. Attribution of this data to a specific person is not possible. 

 

Security by means of technical and organisational measures 

According to Article 32, Paragraph 1 DSGVO, BE-terna uses technical and organisational measures in the processing of data to protect personal data against accidental or intentional manipulation, loss, destruction or access by unauthorised persons. The implemented security measures are improved on an ongoing basis in line with technological developments. 

 

Protection of minors 

Persons under the age of 16 are not permitted to transmit personal data to BE-terna without the consent of a parent or guardian. Persons under the age of 16 are only permitted to provide personal information to BE-terna with the express consent of a parent or guardian, or if they are 16 year or older. This data is processed in accordance with this privacy policy.
